Do I Need a Permit for a Patio, Driveway or Retaining Wall in Knox County?

One of the most common questions we get before a project: do I need a permit? Rules vary by jurisdiction and change over time, so always confirm with your local building department — but here’s the general lay of the land in the Knoxville / Knox County area, and how we handle it.

This is general guidance, not official code. Requirements differ between the City of Knoxville, Knox County, and towns like Farragut, and they change. We verify and pull the right permits for your specific project.

Retaining walls

Often yes. Retaining walls over a certain height — commonly 4 feet measured from the bottom of the footing — typically require an engineered design and a permit. Shorter garden and seat walls usually don’t. Tiered walls can trigger requirements too, depending on spacing. This is safety, not red tape: a tall wall holds back tons of soil.

Patios (on grade)

Usually no for a standard at-grade concrete or paver patio, since it’s not a structure. But HOAs (common in Farragut and newer subdivisions) may have their own approval process, and drainage changes near property lines can matter.

Driveways

Sometimes. A new or widened driveway that ties into a public road often needs a right-of-way or driveway permit from the city/county or TDOT, especially for the apron. Replacing in the same footprint is usually simpler.

Gas fire features

Often yes for the gas work involved in a gas fire pit or fire feature — gas lines are permitted and inspected.
